Fatal accident leads to charges

A Gilmer County teen was killed in an accident on Sunday night. Two more teens were injured and a fourth was arrested at the scene by the Georgia Department of Public Safety.

Max Joseph Evans, 19, of Yukon Road, Ellijay, was arrested and charged with driving under the influence and felony homicide by vehicle in the first degree, according to a Gilmer County booking report.

Patrick Spagnola, 19, who was listed as sitting in the right front seat, according to information from the Georgia State Patrol, was ejected from the vehicle, as were the other two passengers. He was deceased when emergency units arrived.

Cloey Essay, 16, of  Ellijay, was transported to Erlanger Hospital and Jessica Mae Elmore, 18, of Jasper was transported to Wellstar Kennestone.

Evans suffered minor injuries, but was not transported.

A trooper responded to a single vehicle crash on Highway 282 at 10:10 p.m., May 31, according to information released by the Georgia Department of Public Safety.

A preliminary investigation indicated Evans, who was determined to be the driver, lost control of the vehicle and overturned off the south shoulder of the road, striking a tree.

Evans was determined to be under the influence of alcohol and arrested at the scene, according to the report.

The Georgia State Patrol Specialized Collision Reconstruction Team is assisting with the investigation.

All charges are pending the completion of the SCRT investigation.
