Three defendants pled guilty in a case involving the death of a Pickens County woman.
Mallory Warden, a 19-year-old, died after being shot.
“This is an extremely sad and unfortunate case where one young lady lost her life, and many young people have ruined theirs,” Gilmer County Sheriff Stacy Nicholson said. “It’s such a waste.”
Gary Anthony McClure, 21, was originally charged with felony murder and criminal attempt to commit a felony.
A plea bargain saw the first charge drop to voluntary manslaughter.
On this charge, the court sentenced him to 20 years in prison. On the second charge, it sentenced him to 10 years on probation.
McClure also must pay $500 in attorney fees.
He pled guilty to both these offenses.
Madison Alina Grace Perez, 19, pled guilty to robbery and to criminal attempt to commit a felony. These charges were a plea bargain down from an original charge of felony murder.
She was sentenced to five years incarcerated for robbery with 20 years of probation for the first charge, as well as a $1,880 in fines and court fees.
For her second charge, she was sentenced to five years incarcerated and 10 years on probation.
She will serve these sentences at the same time.
After her incarceration ends, she will have 15 years of time on probation.
Elizabeth “Rylie” Sue Henson, 17, pled guilty to robbery by force and received a sentence of 20 years under probation and $2,130 in fines and court costs. This arrangement was a plea bargain down from an original charge of felony robbery.
Her charges of aggravated assault and battery were dropped.
Her parole forbids her from any contact with Brent Kahnke. She was also forbidden from harming, harassing, threatening, intimidating or abusing him.
On probation, these three people are all required to perform 240 hours of community service. They also all agreed not to refuse to testify about this case.
If Henson violates her probation, the rest of her sentence can be served in custody.
Anthony Jared Inestruza-Whisnant, 19, pled on June 13, but has not yet received a sentence as of presstime, Gilmer County Clerk of Court Amy Johnson said.
The others accused in this case, Robert Gabriel Shoilekov, 17, Davonnte Lavon Brehon, 18, and Aspen Leigh Cagle, 15, have yet to receive a sentence.
The four men and Perez were all from Ellijay. Henson and Cagle were from Ball Ground.
Shoilekov, McClure, Brehon, Inestruza-Whisnant, Perez and Cagle were all originally charged with felony murder for Warden’s death.
Henson and Cagle were also charged with felony robbery.
This entire group conspired to commit armed robberies between Ellijay and Jasper, Nicholson said in a past interview. Warden was killed during one of these robberies, he said.
At 10:50 p.m., Sept. 18, 2024, deputies and EMS responded to a 911 call of a person being shot. They found Warden in a vehicle on South Main Street, Ellijay, near the old Kiker’s Supply, with a gunshot wound.
Warden was taken to the hospital where she later died.
“There were four girls in the vehicle,” Nicholson said in a past interview. “She was not the driver. I have to assume they were headed to the hospital.”
Talona Road was the site of the shooting. Nicholson said the vehicle the women were in became disabled on South Main. One of the women in the vehicle called 911.
