Man charged with elder abuse

A Gilmer County man who showed up naked at his parent’s home after midnight was arrested for assaulting both of them, authorities said.

Roy Leon Davenport, 21, of 180 Davenport Lane, was charged Sept. 3 by the sheriff’s office for battery against a person 65 years of age or older (Family Violence Act), criminal trespass (FVA), simple battery and family violence, according to an incident report.

Deputy Harold Hefner reported he was dispatched to a domestic disturbance at 2:11 a.m. and met Cpl. Andy Page and Davenport’s father on his front porch. The father said his son was inside the house and had “hit him,” the report states.

“I then entered the residence where Roy Davenport was sitting in a reclining chair naked with a pair of shorts draped over his lap ... I then asked Roy to put his clothes on so we could talk to him and he did,” Hefner wrote, adding Page “asked Roy how many beers he had and Roy gave a thumbs up.”

“Roy was asked what had happened tonight, and he stated that he came home to his father’s house and his father told him that he was not going to drink anymore. According to Roy, that is all that happened and he went and sat in the chair,” according to the report.

The mother and father told Hefner their son “had come over naked and began knocking on the front door at approximately 1:49 a.m. (The mother) unlocked the door, and Roy made his way into the house ... and when (the father) tried to get Roy to go back home and get some clothes on ... Roy began hitting him, knocking him to the ground.”

“Once on the ground, Roy began kicking his father in the leg and proceeded to hit him with his fist,” the report states.

“(The father) stated that he had just had surgery on his hip two weeks prior to the incident ... (the mother) then tried to get Roy off (the father), and (Roy) grabbed her by the throat and said, ‘Leave me alone.’ (The mother), fearing for her safety, then hit Roy in the head with a Thermos bottle.”

A female neighbor arrived on the scene “to find both (the father) and Roy lying on the living room floor,” and she then called a male neighbor to “come help separate Roy and (the father),” according to the report.

Davenport was still being held in the county jail Tuesday, a spokeswoman said.
