NOTICE OF SUMMONS
TO: W.A. Charters or if deceased the heirs of W.A. Charters, and all other persons having an interest in certain mineral and timber rights.
You are hereby notified that the above-styled action seeking a Judicial Declaration of the Adverse Possession of retained mineral rights and timber rights respecting certain real property in Gilmer County, Georgia, being more particularly described as follows:
TRACT I:
ALL THAT TRACT OR PARCEL OF LAND lying and being in original Land Lot 271, 10th District, 2nd Section of Gilmer County, Georgia, consisting of 73.01 acres, as shown on Plat of Survey, dated April 1999, revised on March 2, 2006, by Joel Jordan, Georgia Registered Land Surveyor No. 2430 is recorded in Plat Book 47, Page 33, Gilmer County, Georgia records, with reference made thereto for the purpose of incorporating the same.
TRACT II:
ALL THAT TRACT OR PARCEL OF LAND lying and being in original Land Lot 271, 10th District, 2nd Section of Gilmer County, Georgia, consisting of 73.55 acres, as shown on Plat of Survey, dated April 1999, revised on March 2, 2006, by Joel Jordan, Georgia Registered Land Surveyor No. 2430 is recorded in Plat Book 47, Page 33, Gilmer County, Georgia records, with reference made thereto for the purpose of incorporating the same.
The lawsuit was filed against you in said court on 12th day of April, 2013, and that by reason of an Order for Service of Summons by Publication entered by the Court on the 16th day of April, 2013, you are hereby commanded and required to file with the clerk of said court and serve upon Kayann Hayden West, plaintiffs' attorney, whose address is 24 South Main Street, Suite E, Ellijay, Georgia 30540, an answer to the Complaint within sixty (60) days of the date of the order for service by publication.
